Playing the Birthday song on my site?

Can I use the good old birthday song on my website? I heard I might have to pay royalties to some dude somewhere for using it, but I am not sure. I did find another song that I think I can use, and it is actually a lot cooler than the old birthday song, it's called glad you were born today.. anyways any help would be appreciated.

Heh, I doubt you would encounter problems of a legal nature but I am not exactly sure. I think there is a time limit on old stuff like that.

Happy Birthday, If I am not mistaken was written by Irving Berlin. It is the most played song anywhere in the world, and yes ASCAP/BMI fees do apply for commercial use.

why would you want that for your site anyways? would that be helpful for a website to have a theme song or something? will that have any effect for the sites speed in getting it loaded?
